Welcome to the Bugatti NFT Project by The Bugatti Group Inc. (“Bugatti”, “we”, “us”, "our“). Bugatti is committed to protecting the privacy of its customers and users, and we make every effort to ensure that our customers and users understand the nature, purposes and consequences of the collection, use, and disclosure of their personal information, which we explain in this Privacy Notice.

For the purposes of this Privacy Notice, “personal information” means any information that can reasonably be used, either alone or in combination with other information, to identify you.

1.    When does this Privacy Notice apply?

This Privacy Notice explains how Bugatti collects, uses, and discloses your personal information when you use or access, (the “Site”). Through the Site, you are permitted to purchase non-fungible tokens (“NFTs”) created by or on behalf of the Bugatti NFT Project. All NFTs are originally minted by Bugatti (“Bugatti NFT”). Bugatti NFTs will have certain traits, features, perks or other similar characteristics (the “Utility” of a Bugatti NFT) that may be accessible to the person who possesses the Bugatti NFT (the “NFT Holder”) in accordance with our Terms and Conditions found here. In addition, this Privacy Notice applies to information we may collect from you when you communicate with us via email, telephone or other means about Bugatti NFTs.

2.    What personal information does Bugatti collect and how does it collect it?

We may collect the following types of personal information directly from you at the point of purchase or service, when you make customer service inquiries, or when we respond to your requests for information:

  • Payment Information, such as Digital Wallet Information(your public key address, information related to your Bugatti NFT, and information about your wallet activity) or Credit Card Information (credit card number, expiry date, …), depending on the method of payment you choose to purchase a Bugatti NFT;
  • Shipping Information, such as your name, phone number, and address;
  • Communications information: such as your name, email address, phone number and the content of your correspondence with us.

We may automatically collect certain technical information from any device that you use to visit our Site, including:

  • Your device’s IP address, web browser type and version, hardware model, time zone setting, browser plug-in types and versions, and operating system, as well as your internet service provider.
  • Information about how you use the Site, including the uniform resource locators (“URLs”) of other websites that you click to and from our Site (including the date and time clicked), page response times, download errors, length of visits to certain pages on the Site, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

3.    How does Bugatti use your personal information?

We may use your personal information to:

  • Present our Site and its contents to you;
  • Communicate with you;
  • Enter into and perform transactions related to Bugatti NFTs;
  • To ship you any physical Utility you have ordered ;
  • Maintain our customer service records;
  • Respond to your requests, complaints, comments and questions, when you contact us by phone or email, or via our “Contact Us” page on the Site;
  • With your prior express consent, send you promotional communications and surveys about your shopping preferences;
  • Improve your experience on the Site;
  • Satisfy any audit, insurance, self-regulatory or regulatory requirements applicable to us;
  • Track and promote the listing of your Bugatti NFT when you list your NFT for sale on a secondary marketplaces (ex. Opensea);
  • Detect and prevent security threats to the Site.


We may use cookies and other similar technologies to automatically collect certain information about visitors to our Site. A “cookie” is a unique numeric code that we transfer to your computer that identifies your browser to our server when you visit various pages of the Site. We use cookies to save your interactions with our Site so that your information is maintained as you interact with the Site. Any cookie sent to your computer by Bugatti in connection with your use of the Site does not give us access to your computer.

5.    Can I opt-out of promotional emails?

6.    Links to third-party sites

Our Site may incorporate links to other sites, such as third-party social networking services. By clicking on such links, you will leave the Site. We are not responsible for the privacy policies, the content or the data handling practices of other websites. We do not control the operation of any third parties’ websites or applications, and any personal information you submit through these sites is subject to their privacy policy, and not Bugatti’s. This Privacy Notice does not extend beyond our Site. We recommend that you read the privacy policy of any such third-party website.

7.    How and why does Bugatti share my personal information?

In order for us to fulfill the purposes described above at Section 3 of this Privacy Notice, we need to share your information with third parties.

We may share your personal information with the following:

  • Service providers that perform certain services on our behalf, such as:
    • technical services (Cloud hosting and server providers who help us design, administer and maintain the Site);
    • marketing agencies who help us conduct promotional campaigns and surveys;
    • delivery services companies who ship Utilities to you; and
    • payment processing providers who assist us with completing your transactions.
  • Third-parties that assist us with necessary legal advice or to comply with insurance, legal or regulatory obligations;
  • Third-parties as a result of, or in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization, or liquidation; and We only allow third parties to process information for the sole purpose of carrying out the above services on our behalf.

These service providers may require access to your personal information in order to perform these functions on our behalf. These entities are under legal and contractual obligations to comply with applicable privacy and data protection legislation, to safeguard your personal information in accordance with the sensitivity of the information, to only use the personal information provided to them for the purposes in which it was disclosed to them, and to comply with this Privacy Notice.

We may disclose your personal information with government, regulatory or law enforcement agencies as requested by these agencies, if we have a good faith belief that the disclosure is required or permitted by law. We may also disclose your personal information in order to enforce our legal rights; to detect, prevent or address fraud or security issues; and to enforce ours or others’ legal rights, property, or safety.

We do not trade, rent or sell your personal information.

8.    How does Bugatti keep my personal information safe?

Bugatti maintains commercially reasonable security methods, including the use of data security and encryption standards, to protect your personal information against unauthorized use, loss, access, modification, destruction or disclosure while it is in our custody or under our control and to ensure that your personal information in our custody is accurate and up-to-date for the purposes for which the information was collected. We regularly review our collection, storage, and processing practices to prevent unauthorized access to our systems. We restrict access to your personal information to only those Bugatti personnel and service providers who require that information to carry out the purposes identified above at Section 3 of this Privacy Notice, and anyone with this access is subject to strict confidentiality obligations. However, you should be aware that no system is 100% secure, and despite our best efforts, we cannot guarantee that your information will be secure, particularly while it is in transit over the Internet.

We only retain your personal information for as long as necessary to fulfill the purposes we have identified throughout this Privacy Notice, or as otherwise required or permitted by law. When no longer necessary, we safely destroy or anonymize your personal information that is no longer required for the purpose for which it was collected, including for the purposes of processing the products or services you requested or meeting any legal or reporting requirements.

If we use third-parties service providers, we require such service providers to use similar safeguards to those used by us, and also require service providers to limit access to your personal information on a “need to know” basis as well as to keep it strictly confidential. Service providers are only permitted to use your personal information for the sole purpose of carrying out services on our behalf.

While our physical servers are located in Quebec, Canada, we also store information using Amazon Cloud Services. This means that your personal information may be transferred to or processed in other jurisdictions. Information stored in a foreign jurisdiction may be subject to the laws of that jurisdiction and may be accessible to regulatory authorities in accordance with the laws of that jurisdiction. If your personal information is transferred outside of your jurisdiction, we will take steps to ensure your information is adequately protected in accordance with applicable privacy and data protection laws.

9.    How can I access, correct or delete my personal information?

At any time, you may request information on the types of personal information Bugatti has about you, what it is being used for, and with whom it has been shared. Bugatti may also provide you with a copy of your personal information it holds about you, subject to certain exceptions such as: any personal information about another individual that cannot be separated from yours , any information subject to solicitor-client privilege, commercially confidential information, information that may threaten life or security of an individual, or information collected for purposes related to an investigation of a breach of an agreement or contravention of law.

If you notice any inaccuracies or wish to update any of your personal information, you may request that we correct or update it.

At any time, you may withdraw your consent to the collection, use, disclosure or any other form of processing of your personal information, subject to contractual or legal restrictions. Please note that if you withdraw your consent, we may not be able to provide you with a particular product or service. At any time, you may wish to exercise any of these rights by making a written request to We may not accommodate a request if we believe the change would violate any law or legal requirement.
